Sources of Information

The main source of information is collected from the account opening application form you have submitted to KGI Ong Capital when you established a relationship with us. Furthermore, we may require other additional information as and when in order to open an account with KGI Ong Capital.
 

Information obtained from you

If you have established a relationship with KGI Ong Capital as a capacity of an individual, corporate, institutional, or other investment vehicle acting on your behalf, the information we collected from you would include:

  • Your account type, name, address and country.
  • Your email address and your contact number.
  • Your trading interest on which kind of our products.
  • Any other necessary information required for the processing of account
     

We would not require further information other than what is necessary for the sole purpose of opening an account with us. However, failure to provide us with the necessary information will lead to unnecessary delays in processing your account. While we make an effort to keep the personal information obtained up-to-date, you can help us by informing us of any changes and we will update our records.

a) when you submit any form, including but not limited to application forms or other forms relating to any of our products or services or any investments which you purchase through the Companies;
 
b) when you enter into any agreement or provide other documentation or information in respect of your interactions with us, or when you use our services;
 
c) when you interact with our staff, including marketing executives, client services managers and their assistants, example via telephone calls (which may be recorded), letters, fax, faceto- face meetings and emails;
 
d) when your images are captured by us via closed-circuit television cameras (“CCTVs”) while you are within our premises, or via photographs or videos taken by us or our representatives when you attend events hosted by us;
 
e) when you use some of our services provided through online and other technology platforms, such as websites and apps, including when you establish any online accounts with us;
 
f) when you request that we contact you, or include you in an email or other mailing list; or when you respond to our request for additional Personal Data, our promotions and other initiatives;
 
g) when you are contacted by, and respond to, our marketing representatives, agents and other service providers;
 
h) when we seek information about you and receive your Personal Data from third parties in connection with your relationship with us, for example, from referrers, business partners, external or independent asset managers, public agencies or the relevant authorities;
 
i) through physical access, internet and information technology monitoring processes;
 
j) in connection with any investigation, litigation, registration or professional disciplinary matter, criminal prosecution, inquest or inquiry which may relate to you or any Connected Person; and/or
 
k) when you submit your Personal Data to us for any other reason.
 
1.2 When you browse our website, you generally do so anonymously but please see section 4.0 below on cookies. We do not, at our website, automatically collect Personal Data, including your email address unless you provide such information or login with your account credentials.
 
1.3 If you provide us with any Personal Data relating to a third party (for example, information of your spouse, children, parents, or a Connected Person), by submitting such information to us, you represent to us that you have obtained the consent of the third party to you providing us with his/her Personal Data for the respective purposes. “Connected Person” may include but is not limited to any beneficial owner, authorised signatory, director, shareholder, officer of a company, partner or member of a partnership, settlor, trustee, beneficial owner, protector or grantor of trust, mandate holder, power of attorney holder, surety, third party security provider, provider of funds, founder and/or employee, payee of designated payment, representatives, agents or nominees.
 
1.4 You should ensure that all Personal Data submitted to us is complete, accurate, true and correct. Failure on your part to do so may result in our inability to provide you with products and services you have requested. You agree to inform KGI Ong Capital immediately of any change of facts or circumstances which may render any information or Personal Data previously provided inaccurate, untrue or incorrect and provide any information or documentation as KGI Ong Capital may reasonably require for the purposes of verifying the accuracy of the updated information or Personal Data.
 
2.0 Purposes for the Collection, Use and Disclosure of Your Personal Data
 
2.1 Depending on the circumstances, KGI Ong Capital collects, uses and discloses your Personal Data for the following purposes:
 
a) responding to, processing and handling your complaints, queries, requests, feedback and suggestions;
 
b) verifying your identity and customer due diligence;
 
c) managing the administrative and business operations of the Companies and complying with internal policies and procedures (including but not limited to facilitating business continuity planning);
 
d) audit purposes;
 
e) verifying or confirming trade orders or instructions from you or for your account (including but not limited to instructions on fund transfers or remittances);
 
f) facilitating business asset transactions (which may extend to any mergers, acquisitions or asset sales) involving any of the Companies;
 
g) matching any Personal Data held which relates to you for any of the purposes listed herein;
 
h) resolving complaints and handling requests and enquiries;
 
i) preventing, detecting and investigating crime, including fraud and money-laundering or terrorist financing, and analysing and managing commercial risks (including but not limited to preventing and detecting loss of KGI Ong Capital’s proprietary and sensitive information);
 
j) project management;
 
k) providing media announcements and responses, for example in relation to complaints or law suits;
 
l) requesting feedback or participation in surveys, as well as conducting market research and/or analysis for statistical, profiling or other purposes for us to design our products, understand customer behaviour, preferences and market trends, and to review, develop and improve the quality of our products and services;
 
m) managing the safety and security of our premises and services (including but not limited to carrying out CCTV surveillance and conducting security clearances);
 
n) managing and preparing reports on incidents and accidents;
 
o) organising events, seminars or trainings;
 
p) complying with any applicable rules, laws and regulations, codes of practice or guidelines, obligations, requirements or arrangements for collecting, using and disclosing Personal Data that apply to KGI Ong Capital or that it is expected to comply, according to:
i) any law binding or applying to it within or outside Singapore existing currently and in the future;
ii) any guidelines or guidance given or issued by any legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers within or outside Singapore existing currently and in the future;
iii) any present or future contractual or other commitment with local or foreign legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers that is assumed by or imposed on KGI Ong Capital by reason of its financial, commercial, business, or other interests or activities in or related to the jurisdiction of the relevant local or foreign legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations;
 
q) to assist in law enforcement and investigations by relevant authorities;
 
r) in connection with any claims, actions or proceedings (including but not limited to drafting and reviewing documents, transaction documentation, obtaining legal advice, and facilitating dispute resolution), and/or protecting and enforcing our contractual and legal rights and obligations;
 
s) archival management (including but not limited to warehouse storage and retrievals); and/or
 
t) any other purpose relating to any of the above. These purposes may also apply even if you do not maintain any account(s) with us, or have terminated these account(s). As for the purposes which may not appear above, we will notify you of such other purpose at the time of collection of your Personal Data and obtaining your consent, unless processing of your personal data without your consent is permitted by the PDPA or by law.
 
2.2 In addition, KGI Ong Capital collects, uses and discloses your Personal Data for the following purposes depending on the nature of our relationship: 
 
a) If you are a prospective customer:
i. assessing and processing any applications or requests made by you for products and services offered by KGI Ong Capital; and/or
ii. any other purpose relating to any of the above.
 
b) If you are a customer holding an account with KGI Ong Capital or a Connected Person or an administrator, executor, liquidator, official assignee, receiver, judicial manager or other similar official who has been so appointed pursuant to bankruptcy or insolvency proceedings instituted in Singapore or elsewhere in respect of a KGI Ong Capital customer or any security provider:
 
i. opening, maintaining or closing of accounts and our establishing or providing trading services to you;
ii. processing fund transfers or any other instructions provided in relation to the account of a KGI Ong Capital customer;
iii. processing applications for and facilitating the daily operation of services and credit facilities provided to you or other persons or corporations for whom you act as surety or third party service provider;
iv. conducting credit checks at the time of application for credit and at the time of regular or special credit reviews;
v. facilitating or processing your application for trading products and/or other services offered by KGI Ong Capital and its business partners; 
vi. to establish your financial situation and investment experience and;
vii. providing web trading services or online services (including but not limited to carrying out special handling requests for PIN mailers and tokens);
viii. networking to maintain customer relationship;
ix. providing client servicing (including but not limited to responding to individual requests by customers, mailing services, reconciliation services and providing customer satisfaction);
x. facilitating the transfer of funds within KGI Ong Capital trading accounts or from KGI Ong Capital trading accounts to external bank accounts and vice versa;
xi. administering exceptional approvals, fee adjustments or waivers;
xii. registering the pledge or charge that you or the surety or the third party security provider has granted in favour of KGI Ong Capital as security for the credit facilities granted by KGI Ong Capital to you; 
xiii. enabling any Company or third party to perform the functions that KGI Ong Capital may have outsourced to it in relation to the management of your account or transactions;
xiv. any other purpose relating to any of the above.
 
c) If you are an employee or agent of a referrer or other intermediary:
i. marketing services and products;
ii. processing commission remuneration;
iii. performing due diligence and reference checks; and/or
iv. any other purpose relating to any of the above.
 
d) If you are an employee, officer or owner of an external service provider or vendor outsourced or prospected by KGI Ong Capital:
i. managing project tenders or the supply of goods and services;
ii. processing and payment of vendor invoices;
iii. complying with any applicable rules, laws and regulations, codes of practice or guidelines or to assist law enforcement and investigation by relevant authorities (which includes disclosure to regulatory bodies or audit checks); and/or
iv. any other purpose relating to any of the above.
 
e) If you are a party or counterparty to a transaction (for example, a beneficiary of a fund transfer or payment):
i. providing cash, payment and transactional services (including but not limited to the execution, settlement, reporting and/or clearing of the relevant transaction); and/or
ii. any other purpose relating to any of the above.
 
2.3 In addition, where permitted under the Personal Data Protection Act, KGI Ong Capital may also collect, use and disclose your Personal Data for the following purposes (which we may describe in our documents and agreements as "Additional Purposes" for the handling of Personal Data):
 
a) providing or marketing services, products and benefits to you, including promotions, loyalty and reward programmes;
b) matching Personal Data with other data collected for other purposes and from other sources (including third parties) in connection with the provision or offering of products and services, whether by KGI Ong Capital or other third parties;
 
c) sending you details of products, services, special offers and rewards, investment or research reports or guides, either to our customers generally, or which we have identified may be of interest to you; and/or
 
d) conducting market research, understanding and analysing customer behaviour, location, preferences and demographics for us to offer you products and services as well as special offers and marketing programmes which may be relevant to your preferences and profile.
 
2.4 If you have provided your Singapore telephone number(s) and have indicated that you consent to receiving marketing or promotional information via your Singapore telephone number(s), then from time to time, KGI Ong Capital may contact you using such Singapore telephone number(s) (including via voice calls, text, fax or other means) with information about our products and services (including discounts and special offers).
 
2.5 In relation to particular products or services or in your interactions with us, we may also have specifically notified you of other purposes for which we collect, use or disclose your Personal Data. If so, we will collect, use and disclose your Personal Data for these additional purposes as well, unless we have specifically notified you otherwise.
 
3.0 Disclosure of Personal Data
 
3.1 KGI Ong Capital will take reasonable steps to protect your Personal Data against unauthorised disclosure. Subject to the provisions of any applicable law, your Personal Data may be provided, for the purposes listed above (where applicable), to the following entities or parties, whether they are located overseas or in Singapore:
 
a) KGI Ong Capital’s related corporations and overseas branches and offices;
 
b) counterparties and their respective banks in relation to transactions for your account including purchasing and selling of investment products, fund transfers, payments, issuance of standby letters of credit, banker’s guarantees or letters of undertaking and drawing of cheques;
 
c) third party recipients of reference letters;
 
d) trustees, attorneys and brokers appointed by you to manage your account held with KGI Ong Capital; 
 
e) referrers who have referred you to KGI Ong Capital;
 
f) agents, contractors, vendors, installers, or third party service providers who provide administrative or operational services to KGI Ong Capital, such as courier services, telecommunications, information technology, payment, payroll, processing, training, market research, storage, archival, customer support investigation services or other services to KGI Ong Capital;
 
g) agents, contractors, vendors or other third party service providers in connection with products and services offered by KGI Ong Capital;
 
h) debt collection agencies;
 
i) your employers which are financial institution, for their internal surveillance or monitoring purposes; 
 
j) any business partner, investor, assignee or transferee (actual or prospective) to facilitate business asset transactions (which may extend to any merger, acquisition or any debt or asset sale) involving any of the Companies; 
 
k) translators;
 
l) our professional advisers such as our auditors and lawyers
 
m) third parties who provide corporate advisory services or due diligence services in connection with you, any Connected Person or your account held with KGI Ong Capital;
 
n) relevant government regulators, government ministries, exchange, statutory boards or authorities or law enforcement agencies who have jurisdiction over KGI Ong Capital or any Company or over any transaction entered into by you, such as the Monetary Authority of Singapore, Singapore Exchange Limited, the Accounting and Corporate Regulatory Authority, the Insolvency and Public Trustee Office, the Inland Revenue Authority of Singapore and the Commissioner of Charities, as well as to comply with other requirements or directions of Singapore Exchange Limited and/or any other relevant exchange;
 
o) any liquidator, receiver, administrator, judicial manager, trustees-in-bankruptcy, custodian or other similar official who has been so appointed, pursuant to bankruptcy, winding-up or insolvency proceedings instituted in Singapore or elsewhere, in respect of you or your assets;
 
p) third parties who carry out registration of charge or pledge over the assets that you have pledged or charged to KGI Ong Capital; 
 
q) corporate service providers or lawyers, who are appointed by you;
 
r) financial institutions, brokerage houses, clearing houses, depository, depository agents, managers, administrators, fund houses, registrars, custodians, external banks, nominee banks and investment vehicles in relation to investment product settlement processing; 
 
s) third parties who organise promotional or marketing events, seminars or trainings; 
 
t) any person to whom KGI Ong Capital or any of the Companies is under an obligation or otherwise required to make disclosure under the requirements of any law binding on or applying to KGI Ong Capital or any of the Companies, or any disclosure under and for the purposes of any guidelines or guidance given or issued by any legal, regulatory, governmental, tax, law enforcement or other authorities, or self-regulatory or industry bodies or associations of financial services providers with which KGI Ong Capital or any of the Companies are expected to comply, or any disclosure pursuant to any contractual or other commitment of KGI Ong Capital or any of the Companies with local or foreign legal, regulatory, governmental, tax, law enforcement or other authorities, or industry bodies or associations of financial services providers, all of which may be within or outside Singapore and may be existing currently and in the future; and/or
 
u) any other party to whom you authorise us to disclose your Personal Data to.
 
4.0 Use of Cookies

Safety Tips for E-Trading

  • NEVER reveal your password to anyone. Be suspicious of any person/ email asking you to provide sensitive trading account information.
  • If you receive such request from anyone/ emails, do take extra precaution to verify that the source is known to be genuine. Do not reply to the person or the email or click on any hyperlink to verify your information and details.
  • Act quickly and contact our credit department at +65 66711833 if you think that your account has been compromised.
  • Do NOT open email attachments from strangers.
  • Delete spam and junk emails.
  • Passwords should be at least 8 alphanumeric characters.
  • Do NOT use obvious passwords, such as your User ID, initials, family names, company name, your date of birth, IC number, telephone number or other numbers / letters that could be guessed easily.
  • Do NOT use passwords from your other registered Internet sites.
  • Do NOT disclose your password to anyone, including Ong First Tradition Pte Ltd staff.
  • Do NOT write down or record the password without first disguising it.
  • Do change your password regularly, e.g. within 90 days. In addition, the new password should NOT be the same from the previous passwords.
  • Always remember to log off from the E-Trading platform when you have completed your trading activities for the day or whenever you are leaving your workstation unattended.
  • Do NOT select the browser option for storing or retaining username and password.
  • Check the authenticity of the eTrading website by comparing the URL with its digital certificate.
  • Ensure the website changes from http:// to https:// for an encrypted session.
  • Check your bank account balance and transactions frequently and report any discrepancy.
  • Ensure your computer is protected with anti-virus, anti-spyware, firewall and have the latest updates.
  • Do NOT use public, internet café or computers, which cannot be trusted to access/perform online transactions.

 

Please note that the above mentioned list is not exhaustive and you must be aware of the risk involved in E-Trading. KGI Ong Capital cannot be responsible for the transactions you carry out or for any loss you may suffer as a result of you using the E-Trading platforms. Report to us immediately on any actual or suspected misuse of your password/ trading account and ensure that such a password is changed without any hesitation or delay.

 

Phishing Alert

If you have received an email requesting that you click on a hyperlink to verify your information and details, do NOT respond.

Please note that under no circumstances will KGI Ong Capital ever send you an email asking for your personal information. You should not respond to such email or reveal your PIN to anyone.

Should you receive further suspicious emails or suspect that there has been any unauthorized breach of your KGI Ong Capital account online or that an online transaction has taken place that you did not initiate, you should notify KGI Ong Capital immediately by calling +65 664 34778.

At KGI Ong Capital, we always have your interest at heart. While we hope that your trading experience can be as pleasant as possible, we would like to advise you to observe and refrain from practices that are prohibited by law under the Securities and Futures Act (“SFA”):

Section 208 on manipulation of price of futures contract and cornering;

Section 209 on fraudulently inducing persons to trade in futures contracts;

Section 210 on employment of fraudulent or deceptive devices;

Section 211 on dissemination of information about illegal transactions;

System Functionalities and Order Management Procedures

  1. System access requirements: All our E-Trading platforms require users to have a valid user ID and password to login.
     
  2. How to place, modify and withdraw orders: Before you commence trading, please ensure that you have been educated by our I.T trainer on the operating of the e-trading platform in placing, modification and withdrawal of orders. Please ensure that you are equipped with the necessary skills and knowledge on operating of the e-trading system. 
    You should not attempt to use if you are not trained.  You are also advised to check on the status of your order after every execution.
     
  3. Types of trading controls e.g. types of error-prevention alerts and how to interpret system alerts:  Our e-trading platforms are equipped with error-prevention features on maximum quantity per order to alert customers of possible erroneous entries in relation to quantity and price alerts to alert customers of possible erroneous entries in relation to price.
